Support with compensation matters
Infortunistica Antoniana helps family members gather documents, examine liability and assess harm. Technical, medico-legal and legal aspects are investigated according to the case, including where criminal investigations are ongoing.
The initial consultation helps clarify the process and the information available. You can also read our article on bereavement compensation following a road accident.
Each family member’s position must be assessed individually
Each family member’s position must be assessed individually. Kinship, cohabitation, the stability and closeness of the relationship and the consequences of the loss all need to be examined: a general list of family relationships is not enough to establish an automatic right to compensation.
Our article on compensation for the loss of a family member provides initial guidance.
Family members’ losses and inherited rights
Harm suffered directly by family members must be distinguished from any compensation rights accrued by the deceased and passed on to the heirs. These are separate matters, with specific requirements and evidence. Our article on compensation inherited from the deceased (iure hereditatis) explains this distinction.
The assessment may cover suffering and disruption to family life, as well as demonstrable financial consequences such as the loss of the deceased’s contribution. The applicable tables help quantify compensation but do not replace an examination of the actual circumstances.
Documentation and the circumstances of the incident
Together with the family, we gather documents that help establish the incident, the relationship with the loved one and the consequences suffered. Official records, available investigations and any technical evidence must be examined carefully. An accident reconstruction can help clarify liability.
Support for the family also includes examining needs connected with the case, such as psychological support and funeral expenses, under the arrangements agreed with the practice.
If the death occurred at work
INAIL benefits and any compensation rights require a coordinated assessment. See our page on serious and fatal workplace accidents and our article on INAIL protection for heirs.
