INAIL benefits and compensation: two assessments to coordinate
INAIL provides statutory occupational accident insurance benefits where the requirements are met. These benefits do not necessarily correspond to full compensation for harm under civil law. The circumstances of the incident, any liability and the actual consequences for the worker must be examined.
Where there are grounds, a claim against the employer or other liable parties may be considered for further compensable harm. The so-called differential damages are not an automatic amount: they require legal and medico-legal assessment and a proper comparison with benefits already awarded.
Our articles on how INAIL compensates bodily injury and on challenging an INAIL assessment examine these aspects in depth.
The consequences of a serious injury
Complex fractures, neurological injuries or other disabling outcomes may involve prolonged treatment, loss of independence and difficulty returning to work. The analysis covers temporary incapacity, permanent impairment, demonstrable expenses and future needs, as well as any reduction in earning capacity.
Our page on serious injuries and major permanent impairment describes how to gather evidence relating to treatment, care, independence and family life.
If the worker dies
We support family members in examining the benefits available and any rights to compensation. Family members’ own rights must be distinguished from any rights passed on to heirs; beneficiaries, requirements and evidence may differ. The financial consequences of losing the worker’s support also require specific examination.
See our articles on INAIL pensions and protection following a worker’s death and compensation inherited from the deceased (iure hereditatis). For matters relating to bereavement, see also our page on fatal accidents.
Documents to gather
- Medical reports, certificates, records and rehabilitation documents.
- Accident notification, INAIL correspondence and decisions.
- Evidence of the circumstances: witness accounts, photographs and available investigation records.
- Documents about job duties and income, as well as expenses incurred.
- Any insurance policies and correspondence already received.
We help you organise the documentation and identify the investigations needed. Deadlines and procedures should be checked promptly against the specific case.
Accidents while commuting to and from work
A commuting accident may also involve INAIL protection and road traffic liability where the required conditions are met. It is useful to coordinate claims and assess the relationship between benefits and compensation: we discuss this in our article on INAIL’s recovery rights in commuting accidents.
