What an accident claims agency does
After an incident, it can be difficult to understand which documents are needed, who to address the claim to and how to interpret a settlement offer. Out-of-court claims assistance covers these steps and, depending on the needs of the case, is complemented by technical and medico-legal assessments and the involvement of legal professionals.
Infortunistica Antoniana handles road traffic accidents, injuries, medical negligence and other types of harm.
Liability, evidence and harm
A compensation claim requires liability to be established and the consequences of the incident to be documented. The rules may differ between contractual and non-contractual liability and according to the parties involved. Documentation helps link the harm to the events and substantiate its financial assessment.
Financial losses
These are the economic consequences: expenses incurred and losses sustained, including lost earnings where they can be demonstrated. Repairs, treatment, care and reduced income require specific supporting evidence; serious cases also call for an assessment of future needs.
Non-financial harm
The assessment may include temporary and permanent harm to health and, where the relevant conditions are met, emotional suffering and particular effects on the person’s life. The different elements must be correctly distinguished to avoid compensating the same harm twice.
For guidance, see our articles on temporary incapacity, the bodily injury compensation tables and emotional suffering and individual adjustment of compensation. The tables do not replace an assessment of individual circumstances.
Insurance benefits and compensation are not always the same
A private policy or public insurance scheme may provide benefits under its own rules. A compensation claim against the liable party follows a different process; the relationship between the amounts received must be assessed case by case. We discuss this on our pages about injuries and in our article on personal accident insurance and compensation.
The claims process
- An initial discussion of the events and the documents available.
- Further examination of liability and the consequences of the harm.
- Preparing and handling the claim with the appropriate party.
- Reviewing the offer and any further action with the professionals involved.
For road accidents, the CARD direct compensation procedure may apply, but only where the required conditions are met. The process and timescales depend on the case and on the completeness of the claim.
